Terms and Conditions

1. PRICING

1.1. All prices quoted for goods and services include GST unless otherwise specified.
1.2. Studio PP may, from time to time, vary its prices to take account of, amongst other things, any change in the cost of providing the goods and services, by providing prior written notice to you. Any changes to the prices will take effect from the date specified in the notice.

2. PAYMENT

2.1. If payment is made by direct debit, then you authorise Studio PP or their direct debit provider to debit the relevant amount from your nominated bank account.
2.2. If the debit day falls on a day that is not a business day, Studio PP may debit your account on the following business day.
2.3. You must ensure that you have sufficient funds in your nominated bank account at all times.
2.4. If your direct debit payment is dishonoured then Studio PP may contact you in writing in which case you will have 7 days to provide a valid reason for the default, or to remedy the default. If no action is taken in this time then Studio PP may terminate your membership without notice.
2.5. Studio PP will be entitled to pass on to you the amount that Studio PP’s direct debit provider charge it for your dishonoured payment(s). You may also be charged a fee by your financial institution. If you believe that there has been an error in debiting your account, you should contact Studio PP in writing as soon as possible.
2.6. You must notify Studio PP of a change in your credit card details at least 48 hours prior to your next scheduled direct debit.

3. MEMBERSHIPS

3.1 All memberships are activated as a week-to-week contract and automatically renew on the same day every week.
3.2. You warrant that any information you provide to Studio PP on your membership application form is true and correct. You must provide Studio PP with notice of any change to the information provided on your membership application within 14 days of that change.
3.3. Memberships are not refundable or transferable unless otherwise agreed by Studio PP. Members found sharing their memberships may have their membership suspended or terminated by Studio PP.

Membership Cancellation
You must provide Studio PP with at least 2 weeks written notice to cancel your membership.
You may apply to Studio PP in writing for a suspension of your membership at least seven days prior to your time away. Suspensions are permitted for a minimum period of 1 week and up to 6 weeks at a time.

Appointment cancellation (Applicable for all 1:1 sessions + private group training)
We know life gets in the way of life sometimes and are happy for you to modify your booking at any time up until 24 hours beforehand.
If you need to cancel within 24 to 12 hours prior, 50% of the session/1:1 cost is required and we will process this automatically via your stored credit card details.
Cancellations made less than 12 hours prior will be charged the full appointment cost. (Discretion applied as required)
Once you’ve received the booking confirmation via email, you have accepted these conditions.

Class cancellation (Studio 1, 2 & 3 Public Group Training Classes)

If you need to reschedule or cancel a class please do so within the cancellation windows to avoid a cancellation fee or loss of credit:

STUDIO ONE  

12 hour cancellation policy applies for all reformer Pilates classes. Cancellations made with less than 12 hours notice will result in a Late Cancel fee of $10 for all members and the loss of a credit for all students with single or package pricing options.

STUDIO TWO & THREE 

6 hour cancellation policy applies for all group fitness classes. Cancellations made with less than 6 hours notice will result in a Late Cancel fee of $5 for all members and the loss of a credit for all students with single or package pricing options.

3.4. Absence to class without a cancellation will result in a No Show Fee for all Members of $10 per Reformer Pilates class and $5 for Studio 2 & 3 Classes and the loss of a credit for all clients with single or package pricing options.
3.6. New policy: Please arrive at least 5 minutes before class. No late entry more than 10 minutes past the class start time. If class begins and you’re not checked in, your spot may be given to a standby/waitlisted student.
3.7. You must cancel via the MindBody App or via Phone Call. Cancellations by text, email, Facebook or any other method will not be accepted.
3.8. Some classes book out so we recommend booking in advance to avoid disappointment. Members can book up to 2 weeks in advance.

4. TERMINATION

4.1. Studio PP may terminate your membership without notice for inappropriate, offensive or illegal behaviour, as determined by us, which occurs on our premises or is directed at our staff or other members.
4.2. You may terminate your membership if you become affected by a long term or permanent injury or illness that will prevent you from using our services. Termination will take effect from the date we receive written confirmation from a medical doctor that your injury or illness will exceed a period of 6 weeks.
Termination of contracts before their completion must be paid in full.

5. 6 CLASSES FOR $60 INTRODUCTORY OFFER

5.1. The  6 Classes for $60 Introductory offer is available to new customers of Studio PP only and is valid for a period of 2 weeks from the date that the first class is attended.
5.2. Once an introductory membership ends, you will need to select a membership option to continue use of the studio.
5.3. Introductory members may attend six classes during the 2 week membership period, excluding any private sessions or events.
5.4. All bookings are subject to Studio PP’s cancellation policy. In the event of a no show or a late cancellation, Studio PP will charge you a $10 fee for Studio One and $5 for Studio Two & Three.

6. CLASS PACKS

6.1. Studio class packs may be purchased for Studio 1 and Studio 2 & 3 separately as follows:
(a) Single visit; (expiring 30 days from the date it is purchased);
(b) 5 class pack (expiring 90 days from the date the first class is booked or attended);
(c) 10 class pack (expiring 90 days from the date the first class is booked or attended);
(d) 20 class pack (expiring 180 days from the date the first class is booked or attended).
6.2. Class packs cannot be refunded, transferred, suspended or extended.
6.3. Class packs for Studio 1 are valid for Reformer Pilates Group Classes only.
6.4. Class packs for Studio 2 are valid for all Studio 2 & 3 Classes; Boxing, HIIT, SpinCore, Yoga, Barre, Mat Pilates, Strength with Physio, Mums & Bubs.
6.4. Class packs are not valid for any private training, workshops, retreats, teacher training or special events.
6.5. Class cancellation (Studio 1, 2 & 3 Public Group Training Classes)

7. STUDIO FITNESS CLASSES

7.1. Studio PP retains the right to refuse studio entry to any person at its sole discretion.
7.2. Any students under 15 years of age must be signed in and accompanied by a parent or guardian.
7.3. You are required to follow all reasonable directions of Studio PP staff and instructors while at the studio.
7.4. All purchases are final. Studio PP will not provide a refund for missed classes for change of mind, temporary ill health or otherwise. If you know you will be unable to attend a class, please cancel your booking in accordance with Studio PP cancellation policies.

8. PHYSICAL CONDITION / INJURIES

8.1 By attending Studio PP you warrant that, to the best of your knowledge, you are in good physical health and have no existing medical conditions that would prevent you from participating in Studio PP’s services, or that would be aggravated by using the services.
8.2. You must consult a doctor or qualified professional if you have any injuries or become aware of any health concerns that may impact on your participation in the services before commencing training at Studio PP.
8.3. If you have an injury or health concern you must notify Studio PP before commencing any training at the Studio.
8.4. It is your responsibility not to use any equipment or undertake any exercise that you suspect may adversely affect any medical condition you have or as per the advice of your healthcare professional.

9. PRIVACY

9.1. Your “personal information” (as defined by the Privacy Act 1988 (Cth)) will only be used by Studio PP or our direct debit provider to provide you with the services contemplated by the Direct Debit Request or these Terms. Studio PP will only disclose such information to third parties to the extent specifically required by law.
9.2. You must not photograph or record other users in Happy Melon’s studios without their express consent.
9.3. You consent to Studio PP’s use of your image in any promotional materials, including on Studio PP’s social media accounts.

10. COACHING SERVICES

10.1. Any information provided by Studio PP staff during coaching sessions is for general information purposes only and should not be regarded as legal, financial or medical advice.
10.2. Studio PP’s coaches may provide you with advice and guidance; however, you acknowledge and agree that you are solely responsible for your own choices and actions and for the outcome of those choices and actions.
10.3. Studio PP staff may take and keep on your file detailed notes of your sessions.
10.4. Studio PP reserves the right to report to the appropriate authorities any situations where you are considered to be at risk of self-harm, or of harming others. Studio PP staff are also under an obligation to report to police any information received from you about the commission of a criminal act.

11. LIABILITY

11.1 WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012 Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the Studio PP is required to ensure that the recreational services it supplies to you- (a) are rendered with due care and skill; and (b) are reasonably fit for any purpose which you, either expressly or by implication, make known to us; and (c) might reasonably be expected to achieve any result you have made known to us. Under section 22 of the Australian Consumer Law and Fair Trading Act 2012 (Vic), Studio PP is entitled to ask you to agree that these statutory guarantees do not apply to you. If you accept this form, you will be agreeing that your rights to sue us under the Australian Consumer Law and Fair Trading Act 2012 if you are killed or injured because the services provided were not in accordance with these guarantees are excluded, restricted or modified in the way set out in this form. NOTE: The change to your rights, as set out in these Terms, does not apply if your death or injury is due to gross negligence on Studio PP’s part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.
11.2. You accept that your use of the facilities provided by Studio PP or at Studio PP’s studio is at your own risk and you acknowledge that the use of the facilities may involve risk or injury whether caused by you or another party. By accepting these Terms and Conditions you agree that Studio PP will not be liable for any personal injury suffered on club premises, or from using our facilities or equipment, unless due to the gross negligence of Studio PP.
11.3. Studio PP staff are not health practitioners. You should obtain medical advice prior to participating in services where appropriate.
11.4. Studio PP does not take any responsibility for any personal belongings brought into or left at the studio.
